Driver caused accident by slowing on I-64, suit claims

Three people claim they sustained various injuries after the driver of the car in which they rode failed to stop in time to avoid striking another vehicle that suddenly halted in front of him.

Angelia LeGrand, Rachel Hunter and Douglas LeGrand filed a lawsuit March 22 in St. Clair County Circuit Court against Mark Anthony Jolly and Christopher J. Dobbs.

The plaintiffs claim they rode as passengers in a vehicle traveling east on Interstate 64 in East St. Louis on July 20, 2008, when Jolly, who drove a vehicle in the same direction stopped suddenly to slow down, not giving Dobbs enough time to halt and causing Dobbs to rear end him.

Because of the accident, the plaintiffs incurred medical costs, lost sums of money from their usual occupations and experienced an impaired earning capacity, according to the complaint.

They blame Jolly in part for causing the collision, saying he drove in such a way as to cause them injury, failed to maintain a proper lookout, failed to apply his brakes, failed to keep his vehicle under proper control, failed to slow down in a timely manner to avoid a collision, drove while under the influence of alcoholic beverages, failed to signal his intention to turn and fled the scene of the accident.

The plaintiffs also placed some of the blame on Dobbs, saying he negligently drove in such a manner as to cause them injury, failed to maintain a proper lookout, drove too fast, drove without adequate brakes, failed to properly apply his brakes, failed to have the vehicle equipped with a working horn, failed to keep his vehicle under proper control, drove while under the influence of intoxicating beverages and allowed his vehicle to follow Jolly's more closely than reasonable.

In their six-count complaint, the plaintiffs seek a judgment of more than $300,000, plus costs.
