City of Edwardsville sued over girl's death

The father and mother of a deceased girl claim the city of Edwardsville failed to keep sanitary sewer facilities safe, causing the girl to be crushed to death after cement walls collapsed on her.

Ryan and Amanda Crow, individually and on behalf of their minor children -- Jordan, Kaylee and Carter Crow -- filed a lawsuit March 26 in Madison County Circuit Court against the city of Edwardsville.

In their 33-count complaint, the Crows seek a judgment of more than $1.6 million, plus costs and other relief the court deems just.

The Crows claim their daughter, Macie Elizabeth Crow, ventured to the sanitary sewer facilities located at 105 Lautner Dr. in Edwardsville on March 27, 2009. Her brother, Jordan Crow, accompanied her.

As the children played in the sanitary sewer facility, concrete walls collapsed on them, killing Macie Elizabeth Crow and severely disabling and disfiguring Jordan Crow, according to the complaint.

Because of Macie Elizabeth Crow's death, her parents and next-of-kin lost her society, consortium, guidance, companionship, love and affection, the complaint says. Because of the walls collapsing on him, Jordan Crow became sick, sore, lame, disordered and disabled; experienced pain and suffering; incurred large medical costs; and sustained disability and disfigurement, the Crows claim.

The Crows blame Edwardsville for causing their children's death and severe injuries, saying the city negligently allowed a dangerous condition to exist on their property, failed to take precautions to remedy the dilapidated sewer walls and ignored the obvious dangers at the sanitary sewer facility. In addition, the city improperly maintained the sanitary sewer facilities, abandoned the sanitary sewer facilities to let them deteriorate, failed to remove the dangerous condition, failed to warn individuals in the vicinity of the dangerous condition, failed to inspect the sanitary sewer facilities, failed to remove the sanitary sewer facility in a timely manner and failed to keep the facilities in good condition, the suit states.
