Car dealership sued for failing to warn customer of spilled substance

A Millstadt man has filed suit against the Cahokia company that he says left a slippery substance on its floor, causing him to fall.

James Kirby claims he slipped on a substance in the hallway of Bob Brockland Pontiac Buick GMC on July 10, 2008.

Because of his fall, Kirby was made sick, sore, lame, disordered and disabled; received injuries to his knee; incurred medical costs; suffered a disability; experienced pain and suffering; and lost wages, according to the complaint filed March 3 in St. Clair County Circuit Court.

Bob Brockland Pontiac Buick GMC negligently allowed a substance to be spilled in its walkway and failed to warn customers of the spilled substance.

Kirby is seeking a judgment of more than $50,000, plus costs.

James R. Williams of Williams, Caponi, Foley and Eckert will be representing him.

St. Clair County Circuit Court case number: 10-L-99.
