Restaurant failed to warn customer that chair and table were elevated from floor

A woman has filed suit against a restaurant that she says failed warn her that her chair and table were elevated from the floor, causing her to fall and fracture her wrist.

Jo Ann Roll claims she was eating at 54th Street Grill in Glen Carbon on March 15, 2008, when she attempted to get up from her seat. Not realizing she was above the floor of the restaurant, Roll fell when she attempted to take a step, according to the complaint filed March 10 in Madison County Circuit Court.

Because of her fall, Roll suffered a fractured wrist, disability and disfigurement; suffered loss of a normal life and pain; incurred medical costs; and lost wages, the suit states.

She blames 54th Street Grill for designing a restaurant with tables and chairs elevated above the floor, for failing to provide adequate lighting and for failing to warn Roll that her table and chairs were elevated above the floor.

Roll seeks a judgment of more than $50,000 but less than $75,000, plus costs.
