The administrator of a man's estate has filed suit against the driver of a vehicle who she says caused a vehicle to overturn while he was on drugs.

Jackie Averbeck claims John Chinn was riding in a Ford Ranger defendant Vance Johnson was driving on the exit ramp of Route 3 onto eastbound Highway 158 in Belleville on Feb. 28, 2008, when he flipped the vehicle.

Because of the accident, Chinn sustained severe and permanent neck, head and back injuries, experienced pain and suffering, lost his wage earning capacity and incurred a loss of enjoyment of life, according to the complaint filed Feb. 25 in St. Clair County Circuit Court.

At the time of the accident, Johnson was driving excessively fast and was under the influence of cocaine, acetaminophen, levamisole, cyclobenzaprine, citalopram, codeine and diltiazem, the suit states.

In her complaint, Averbeck is seeking a judgment of more than $50,000 and exemplary damages, plus costs and other relief the court deems just.

She will be represented by Michael L. McGlynn of McGlynn and McGlynn in Belleville.
