South Illinois Street accident is subject of suit

Three people say they became sick, sore, lame and disordered after a driver struck them.

Herbert Feldt III, Christina Feldt and Bethany Feldt filed a lawsuit Feb. 22 in St. Clair County Circuit Court against Premier Communications and Arnold Tutson Jr.

The Feldts claim Herbert Feldt drove south in the 1000 block of South Illinois Street in Belleville on Feb. 25, 2008, at about 2 p.m. when Tutson, who drove a Chevrolet Silverado owned by Premier Communications in the same direction, struck him. At the time of the collision, Christina Feldt and Bethany Feldt rode as passengers, according to the complaint.

Because of the accident, the plaintiffs became sick, sore, lame, disordered and disabled; incurred medical costs; suffered disability and loss of a normal life; experienced pain and suffering; and lost wages, the suit states.

In addition, Herbert Feldt III received injuries to his back, neck and left shoulder while Christina Feldt and Bethany Feldt received injuries to their backs and necks, the complaint says.

The plaintiffs blame Tutson for causing the accident, saying he failed to keep a proper lookout, drove too fast, failed to keep his vehicle under control, failed to stop or swerve to avoid a collision and failed to reduce his speed to avoid an accident.

In the six-count suit, the plaintiffs seek a judgment of more than $300,000, plus costs.
