Volvo driver claims he was rear-ended on I-270

A man claims he sustained severe and permanent injuries after a driver rear-ended him.

Curte M. Atkinson filed a lawsuit Feb. 1 in Madison County Circuit Court against Teodore Dilita and Motor City Express.

Atkinson claims he drove a 1999 Ford Econoline E-150 east on Interstate 270 near exit 20A in Madison County on Feb. 4, 2008, when Dilita, who drove a 1999 Volvo VN in the same direction, rear-ended him. At the time of the accident, Dilita worked for Motor City Express.

Because of the collision, Atkinson became hindered and prevented from attending to his usual duties and activities and suffered great pain and anguish, according to the complaint.

He blames Dilita for failing to stop or swerve to avoid a collision, for driving without sufficient control, for driving too fast for traffic conditions, for failing to keep an adequate lookout and for failing to drive a vehicle with adequate brakes, the suit states.

In his two-count suit, Atkinson seeks a judgment of more than $100,000 but less than $150,000, plus costs.
