Scooter operator claims car failed to yield right of way

A man claims he sustained broken, crushed, bruised and displaced neck, back, hips and legs after a driver struck his scooter.

Gene E. Baugh filed a lawsuit Jan. 29 in Madison County Circuit Court against Kelee Elizabeth Scott.

Baugh claims he drove a motorized scooter along the sidewalk adjacent to W. First Street in Hartford on April 23 when Scott, who drove a vehicle in her driveway at 115 W. First St., struck him at about 2 p.m.

According to the complaint, Baugh became hindered and prevented from attending to his usual affairs and lost large sums of money in addition to his injuries.

He blames Scott for causing the accident, saying she failed to keep a proper lookout, failed to yield the right-of-way and improperly backed her vehicle into him.

Baugh seeks a judgment of more than $50,000, plus costs.

Joseph E. Hoefert and Jay Tomberlin of Alton will be representing him.

Madison County Circuit Court case number: 10-L-95.
