A man has filed suit against the driver who he claims rear-ended him while he was stopped for a traffic control device.

Homer Tinnon claims he was driving south on Broadway Connector at its intersection with Landmarks Boulevard and was sitting in stopped traffic waiting for a traffic control device on Feb. 2, 2008.

According to the complaint filed Jan. 29 in Madison County Circuit Court, defendant Cindy Jones was also driving in the same direction when she failed to stop and rear-ended Tinnon.

Because of the accident, Tinnon sustained injuries to his back, experienced pain and suffering, lost wages and incurred medical costs, the suit states. In addition, he has been prevented from attending to his usual duties and affairs, the complaint says.

Tinnon blames Jones for causing the accident, saying she negligently failed to keep her eyes on the road, drove too fast, failed to stop at a traffic control device, failed to reduce her speed to avoid a collision, failed to keep a proper lookout and failed to exercise proper control of her vehicle.

Tinnon is seeking a judgment of more than $50,000, plus costs.
