Attorney asks to withdraw in shoulder injury case

The attorney for the plaintiff in a suit over shoulder injuries sustained when a Madison County Transit bus he was riding in hit a curb is asking to bow out.

Granite City attorney Todd Nielson is asking to end his representation of Pontoon Beach plaintiff Jerry Morgan.

Madison County Circuit Judge Barbara Crowder is set to hear the motion at 9 a.m. Feb. 11.

Morgan's suit against the Madison County Transit District, Agency for Community Transit and Jimmy Kie had been set for trial Monday.

According to his Jan. 14 motion, "matters have arisen which render it unreasonably difficult," for Nielson to represent Morgan further.
The motion does not go into greater detail.

Morgan's suit contends that the driver of the bus he failed to look out or slow down as the driver turned. Morgan fell to the floor and injured his left shoulder, he claims.

He is seeking damages in excess of $50,000 and costs.

Defendants are represented by Donald Ohl.

The case is Madison case number 08-L-963.
