Parties settle, case dismissed in doctor/lawyer suit against Belleville firm

An orthopedic surgeon/lawyer's legal malpractice suit has been dismissed, owing to its settlement in December.

Terms of the settlement between Dr. Rocco Marrese and the Belleville law firm of Gundlach, Lee, Eggmann, Boyle & Roessler were not available in court documents.

Both parties in the case presented Madison County Circuit Judge David Hylla with their stipulation for dismissal Jan. 29. Hylla signed the dismissal order the same day.

Marrese sued the Gundlach firm for more than $800,000 in damages and costs.

His suit alleged that the firm made mistakes when it defended him in a medical malpractice suit brought by a man he operated on three times.

The jury in that suit awarded the plaintiff $1.8 million.

The verdict was upheld on appeal.

The case had been set for trial during the first week of December
2009. However, according to the case's docket sheet, the parties settled the day they would have been picking a jury.

The trial had been expected to last two weeks.

Marrese was represented by Glenn Bradford.

The firm was represented by Brent Baldwin.

The case is Madison case number 04-L-082.
