A case management conference is set for Jan. 27 in a suit brought over shots fired three years ago in Bethalto.
Plaintiffs Kevin and Chad McCoy are suing a man who allegedly shot at them and their cars for damages of at least $15,000 per each of their suit's four counts.
The defendant, James Ferando, has filed a motion to dismiss the suit.
Madison County Circuit Judge Barbara Crowder is presiding.
The conference is set to begin at 9 a.m.
According to the complaint, the McCoys were riding in their cars near the intersection of Bethalto and Texas boulevards in Bethalto in September 2007.
Ferando allegedly fired multiple shots at the two men "recklessly and carelessly."
The plaintiffs claim to have suffered severe emotional distress and the loss of a normal life.
Their first amended complaint adds "including physical symptoms," to the emotional distress claims.
Ferando denies the claims in his answer. He has asked the court to throw out the suit.
The McCoys are represented by Joseph Brown of Edwardsville.
Ferando is represented by Jane Unsell of East Alton.
The case is Madison case number 09-L-306.
