Disability payments not forthcoming, woman claims in suit

A woman has filed suit against her insurance company, saying it would not provide her with disability benefits which she claims she should be entitled to.

Joan L. Jones claims she became disabled on Jan. 18, 2009, and should have been entitled to receive long-term disability payments.

At the time of her incident, Jones' insurance company was defendant Aetna Life Insurance Company while co-defendants Kraft Foods Global and Kraft Foods Global Administrative Committee sponsored and administered an ERISA disability insurance policy and contract. Defendant Hartford was the plan administrator for the ERISA disability policy, according to the complaint filed Jan. 13 in Madison County Circuit Court.

Although Jones has demanded the long-term disability payments, the defendants have failed to provide her with them, the suit states.

In her eight-count complaint, Jones is seeking the amount equal to the disability benefits she is owed, which she says exceeds $15,000, plus attorneys' fees and court costs of more than $100,000.
