Mack truck driver sideswipes Achieva, suit claims

A woman claims a Mack truck driver sideswiped her while she drove in Granite City.

Elizabeth Callender filed a lawsuit Dec. 28 in Madison County Circuit Court against Paul Bussett and Brutto Truck Services.

Callender claims she drove her 1998 Oldsmobile Achieva on 19th Street near its intersection with Neidringhaus Avenue on Dec. 9, 2008, when Bussett, who drove a Mack Truck owned by Brutto in the same direction, sideswiped her.

Because of the accident, Callender sustained temporary and permanent injuries, incurred medical costs and has been prevented from attending to her usual duties, according to the complaint.

Callender blames Bussett for the accident, saying he failed to keep a proper lookout, drove too fast, failed to exercise proper control, failed to brake and failed to drive in a single lane.

In the two-count suit, Callender seeks a judgment of more than $100,000, plus costs.

Lanny Darr of Schrempf, Kelly, Napp and Darr in Alton will be representing her.

Madison County Circuit Court case number: 09-L-1401.
