Black ice blamed in suit against Schnucks

A Belleville woman says she sustained lower back injuries after she fell on black ice in a Schnuck Markets parking lot.

Sheila A. Dunn filed a lawsuit Dec. 28 in St. Clair County Circuit Court against The Desco Group and Schnuck Markets.

Dunn claims she parked her vehicle in a handicapped spot in Schnuck Markets' lot located at 5750 North Belt West in Belleville on Dec. 17, 2008.

"When Plaintiff exited the vehicle and walked toward the store, she slipped on an unnatural accumulation of ice in the parking lot," the suit states.

Because of her fall, Dunn suffered lower back injuries that led to great pain, suffering, disability and loss of a normal life and incurred medical costs, according to the complaint. In addition, she lost earnings, the complaint says.

She blames Schnuck Markets and The Desco Group, which owns the grocery store, for causing unnatural piles of snow to accumulate in the parking lot, for allowing unnatural piles of snow and ice to melt and then refreeze, for removing snow and ice from the parking lot in an unnatural manner, for failing to warn customers of the black ice on the parking lot and for failing to put down salt or sand.

In the two-count suit, Dunn seeks a judgment of more than $100,000, plus costs and other relief the court deems just.
