A Madison County jury was unable to begin deliberations Thursday in an Alton foot amputation and accident suit due to witness travel schedules that require more testimony Friday morning.

Circuit Judge David Hylla released jurors at about 2:30 p.m. Thursday, telling them to return for the final testimony, closing arguments and deliberations Friday.

The trial began Monday.

Plaintiff Steven Kirk contends that he was injured severely and lost his right foot when defendant Enver Hamiti ran a stop sign in the Ridge Street area of Alton three years ago and hit his motorcycle.

Kirk is suing for damages in excess of $50,000 and costs.

Hamiti claims that Kirk contributed to the accident.

In testimony Wednesday, Kirk admitted to drinking the day of the accident although he does not remember the entire day. According to testimony and records introduced in the case, his blood alcohol level exceeded the state limit.

Experts have also testified that Kirk was speeding.

The trial will resume at 9 a.m. Friday.

Kirk is represented by Amy Meyer and Chris Kolker.

Hamiti is represented by Mark Kurz.

The case is Madison case number 07-L-165.
