Madison County Circuit Judge Andy Matoesian is scheduled to hear motions in a suit over the disclosure of a Collinsville police officer's mental health records Friday.

Plaintiff Daniel Arvizu is suing the city over what he contends was an illegal disclosure of the records.

The defendant, the City of Collinsville, has yet to file an answer in the April suit.

Arvizu's suit seeks damages in excess of $50,000.

According to the complaint, the City of Collinsville wrongfully disclosed Arvizu's mental health records from his Collinsville Police Department's personnel file to one Bonnie Levo for use in a divorce action.

Arvizu claims he did not authorize the records' release. Under Illinois law, certain records from personnel files cannot be released without the employee's consent.

Arvizu argues that the city violated the statute protecting his mental health records.

He claims he suffered humiliation and a violation of his mental health privacy rights as a result of the disclosure.

The motion hearing is set for 9 a.m. Nov. 13.

Arvizu is represented by Mark Levy of Collinsville.

The city is represented by Christine McClimans of Alton.

The case is Madison case number 09-L-365.
