Brakeman sues BNSF over spinal injuries

A man claims he received severe injuries throughout the course of his career as a brakeman, conductor and switchman for BNSF Railway Company.

Brad Nelson filed a lawsuit Oct. 20 in Madison County Circuit Court against BNSF Railway Company.

Nelson claims he suffered injuries to his spine and lower extremities as a result of his work for the railroad.

In addition to his injuries, Nelson suffered pain and mental anguish, was forced to undergo medical treatment and lost wages, according to the complaint. In addition, he incurred medical costs and his ability to work and enjoy his life have been impaired, the suit states.

Nelson blames BNSF for a number of negligent acts, including its failure to provide him with a safe place to work, its failure to provide safe work conditions, its failure to provide safe methods for work, its failure to enact a comprehensive ergonomics program, its failure to provide safe tools for work, its failure to provide adequate protection from cumulative trauma and its failure to provide adequate training.

Nelson is seeking an unspecified judgment, plus costs.

Steven L. Groves of Holland, Groves, Schnelier and Stolze in St. Louis will be representing him.
