Nursing home fall trial moved to Sept. 2010

The trial of a suit against a nursing over a patient's allegedly fatal fall has been moved to September 2010.

Madison County Circuit Judge Andy Matoesian signed an order Sept. 30 moving the suit's trial to Sept. 20, 2010 at 9 a.m.

Plaintiff R.E. Herren is suing Cathedral Rock of Illinois Inc., the owner of Calhoun Skilled Care for what the plaintiff claims is a breach of care that led to the death of Thelma Herren in January 2003.

According to the complaint, the nursing home where Thelma Herren resided did not have sufficient nursing staff, left her unsupervised and failed to prevent her fall from a shower chair. That fall allegedly injured Thelma Herren's neck and forehead and caused a brain bleed and her death.

R.E. Herren seeks damages in excess of $75,000, costs and attorneys' fees.

The defendant denies the charges.

Bob Perica of Alton represents the plaintiff.

The defendants are represented by Veronica Aimouti of St. Louis and her colleague, Stephen Strum.

Dawn Shaw is also involved in the case and is represented by Robert Edmonds of Alton.

The trial had been set for Oct. 13.

The case is Madison case number 04-L-372.
