Stack to hear motions Aug. 31 in Highland medical negligence case

Madison County Circuit Judge Daniel Stack is set to hear pending motions in a suit against St. Joseph's Hospital in Highland and two radiologists on claims they failed to find an aneurysm that resulted in the amputation of plaintiff's left leg.

The motions were to be heard Aug. 5. That hearing was rescheduled due to Stack's unavailability in an order signed by Madison Associate Judge Ralph Mendelsohn.

Plaintiffs Thomas and Robeye Walker are suing the Hospitals Sisters Health System d/b/a St. Joseph's Hospital, Dr. Shawn Shekar of Highland, Dr. Anthony Sodd of Highland and Mid America Radiology for multiple counts of negligence and loss of consortium. The suit seeks damages for each count of at least $50,000 and costs.

The Walkers contend that the doctors failed to properly read several tests Thomas Walker had down in April 2008 to determine the cause of pain in his leg. The suit alleges the defendants failed to properly read the tests, failed to instruct staff properly, failed to properly diagnose the aneurysm and that failed to refer Thomas Walker to a vascular surgeon to correct the problem.

The diagnosis of the pain's cause was allegedly a cyst.

According to the complaint, Thomas Walker experienced pain, suffering, permanent disfigurement and disability when the aneurysm eventually resulted in the amputation of his leg above the knee. He also claims to have incurred medical bills.

Thomas Walker's wife, Robeye, alleges she lost his support, guidance, consortium and companionship.

The motion hearing is set for 9:30 a.m.

The Walkers are represented by Thomas Q. Keefe Jr. and Kevin Sullivan.

The Hospital Sisters are represented by Michael Nester.

Dr. Shekar is represented by Jeffrey Glass.

Dr. Sodd and Mid America Radiology are represented by Ted Dennis.

The case is Madison case number 08-L-975.
