A St. Clair County man is suing Al's Automotive Supply and one of its employees after he says the employee rear-ended him.

Dean Sample claims he was stopped in his 2001 Cadillac Seville on Illinois Route 157 in Cahokia on Aug. 21, 2007, waiting for a vehicle in front of him to make a left turn.

According to the lawsuit filed Aug. 18 in St. Clair County Circuit Court, Richard Zinn, who was driving for Al's Automotive Supply, failed to stop and struck the rear section of Sample's car.

Because of the accident, Sample suffered injuries, great pain and mental anguish and incurred medical costs, the suit states.

Zinn negligently failed to exercise due care, failed to keep a proper lookout, failed to reduce his speed, failed to keep the vehicle under proper control and failed to maintain a reasonable speed to avoid a collision, the complaint says.

Sample claims Al's Automotive Supply was negligent through respondeat superior.

In the two-count suit, Sample is seeking a judgment of more than $100,000, plus other relief the court deems just.

He will be represented by Brian T. Kreisler of Becker, Paulson, Hoerner and Thompson in Belleville.

St. Clair County Circuit Court case number: 09-L-438.
