Carlyle Avenue accident is subject of suit

A woman has filed suit against the driver who she says caused her severe and permanent injuries to her neck.

Dawn Lush filed a lawsuit Aug. 5 in St. Clair County Circuit Court against Wanda Patterson.

Lush claims she was riding in a vehicle Herbert Lush was driving east on Carlyle Avenue in St. Clair County on Aug. 12, 2007.

Suddenly, Patterson, who was driving behind the vehicle in which Lush was riding, collided with it, according to the complaint.

In addition to her injury, Lush claims she suffered headaches, great bodily pain and loss of a normal life and incurred medical expenses, the suit states.

Patterson negligently failed to keep her vehicle under control, failed to keep a proper lookout, failed to reduce her speed to avoid a collision, failed to apply her brakes, drove too fast and drove too closely to the vehicle in front of her, the complaint says.

Lush is seeking a judgment of more than $50,000, plus costs.

She is represented by Kenneth P. Danzinger of Callis, Papa, Hale, Szewczyk and Danzinger in Granite City.
