A St. Clair County couple say a newly constructed home they purchased for more than $350,000 already has cracks in the drywall and leaking windows.
David H. and Janet M. Bone filed a lawsuit Aug. 3 in St. Clair County Circuit Court against LRB Construction.
They say that in 2003, LRB agreed to build a custom home for them at 14 Castle Point Dr. in Belleville for $373,000.
Around February 2004, after the Bones moved into their home, they noticed the cracks and leaks, according to the complaint.
Despite the Bones' repeated demands, LRB has failed to fix any of the problems or to refund them any money, the suit states.
"That as a direct and proximate result of the Defendant's breach of contract, the Plaintiffs have expended to date substantial monies in an attempt to repair the above-mentioned items, and more costs will be required to be expended in the future in this regard, and further, Plaintiff's home has significantly decreased in value as a result of Defendant's actions," the complaint says.
In the three-count suit, the Bones are seeking a judgment of more than $150,000, plus pre- and post-judgment interest, costs, attorney's fees and other relief the court deems just.
