Parking 'medium' caused woman's injuries, suit claims

By Kelly Holleran | Aug 11, 2009

A woman who blames a parking "medium" for causing her knee and ankle injuries has filed suit against a convenience store.

Kelly Davenport claims she was walking toward an ice machine at the Farm Fresh Dairy Store at 733 Vandalia in Collinsville when she fell over a parking median located near the machine.

According to the complaint filed Aug. 3 in Madison County Circuit Court, Davenport will continue to experience pain and suffering for the remainder of her life and incurred medical costs.

She blames Farm Fresh for failing to exercise ordinary care and for failing to warn her of the parking median.

She is seeking a judgment of more than $50,000, plus costs.

Andrew G. Toennies of Lashly and Baer in St. Louis will be representing Davenport.

Madison County Circuit Court case number: 09-L-804.
