Suit filed over I-55 rear-end collision

A woman has filed suit against Pasha Distribution Services and one of its employees, alleging she was injured after the employee rear-ended her vehicle.

Laura Edwards claims she was driving east on Interstate 55, half a mile west of mile post 1, in East St. Louis on Jan. 26 at about 10:21 p.m. when Charles R. DeWitt, who was driving a vehicle for Pasha Distribution Services, hit the back of her automobile.

Because of the accident, Edwards was made sick, sore, lame, disordered and disabled, received injuries to her neck, head, shoulder and low back and incurred medical costs, according to the complaint filed July 20 in St. Clair County Circuit Court. In addition, she suffered disability, experienced pain and suffering and lost wages, the suit states.

De Witt negligently failed to keep a proper lookout, drove so as to strike the rear of Edwards's vehicle, failed to properly apply his brakes, drove too fast, followed Edwards too closely and drove a vehicle that was not equipped with sufficient brakes, the complaint says.

Edwards claims Pasha Distribution Services is liable for DeWitt's accident because he was their employee at the time.

In the two-count suit, Edwards is seeking a judgment not to exceed $70,000, plus costs.

John H. Hustava of Collinsville will be representing her.

Madison County Circuit Court case number: 09-L-383.
