A grocery store and one of its co-managers are named as defendants in a lawsuit filed by a woman who alleges she fell off a ladder.
Bonnie Levin filed a lawsuit July 8 in St. Clair County Circuit Court against Shop N' Save and Paul Wurth.
In her complaint, Levin alleges she was a contractor and was climbing a step ladder at Shop N' Save in an attempt to place her company's products on the shelves of the store when the incident occurred on June 23, 2008.
The ladder had no rubber stoppers on the bottom of its legs, and it began to shift when Levin climbed it, she alleges. In turn, Levin alleges the movement caused her to slip and fall.
Because of her fall, Levin alleges she was made sick, sore, lame, disordered and disabled; injured her right ankle, right foot, right wrist, right shoulder, neck, back, pelvis and knees and incurred medical costs. In her suit, Levin claims she also suffered disability, experienced pain and suffering and lost money.
Shop N' Save and Wurth negligently failed to provide a good, safe and proper place for Levin to work; allowed the premises to remain in an unsafe and dangerous condition; failed to manage and maintain the premises to make sure it was in good and safe condition and failed to warn Levin of the dangerous condition, according to the complaint.
In the three-count suit, Levin is seeking a judgment of more than $100,000, plus costs. She is also asking the court to enter an order of discovery against Shop N' Save, calling for the identification of people and entities responsible for the incident and requiring those parties to produce tangible evidence.
