A man has filed suit against Diakon Logistics and Sears Logistical Services, claiming his neck and back were injured as the result of a defective door.

Kevin Clemmons says he was delivering freight to Diakon Logistics and Sears Logistical Services in Granite City on June 23, 2007, when a defective freight door injured him.

In addition to his injuries, Clemmons suffered headaches, great physical pain and mental anguish and an impaired function of his body, according to the complaint. He also incurred medical costs of about $60,000, lost his ability to enjoy life and lost wages, the suit states.

Diakon Logistics and Sears Logistical Services failed to maintain the door in a safe condition, failed to warn Clemmons of the defective door and violated various OSHA regulations, the complaint says.

In the two-count suit, Clemmons is seeking a judgment of more than $100,000, plus costs.

He will be represented by Robert W. Butler of St. Louis.
