Granite City dog bite case settles

A dog bite case stemming from an incident in Granite City nearly two years ago has settled.

The case would have been tried beginning at 9 a.m. June 15. Details of the settlement were not available from court documents.

Plaintiff Cheryl Perigan sued fellow Granite City resident Lisa Guilliams for at least $50,000 and costs. Perigan claimed that Guilliams' dog bit her when she was staying with the Guilliams in July 2007. The complaint alleged that the dog bit without provocation.

Perigan claimed to have suffered pain, disfigurement and permanent injuries from the bite. Her complaint also stated that she incurred and will incur medical expenses and that she lost wages.

Guilliams' answer argued that while the dog did bite Perigan, the plaintiff had been warned of the dog's tendencies. According to the answer, the plaintiff attempted to pet the animal anyway and was bitten.

The answer asked the court to reduce the plaintiff's damages accordingly due to her contributory and/or comparative negligence.

The settlement was reached Thursday according to the court docket.

Perigan was represented by Brad Badgley of Belleville. Guilliams was represented by Michael Kokal of Heyl, Royster, and Voelker & Allen.
Madison County Circuit Judge Barbara Crowder was assigned the case.

The case is Madison case number 07-L-832.
