Freeburg man sues Wal-Mart claiming wrongful termination

A Freeburg man is suing Wal-Mart, saying he was wrongfully terminated because he applied for workers' compensation benefits after he was hurt while working.

Glen A. Burgard filed a suit May 12 in St. Clair County Circuit Court against Wal-Mart Stores.

Burgard claims he was an employee of the Belleville Wal-Mart on April 19 when he was involved in an on-the-job accident and was injured.

"The injuries sustained by the plaintiff rendered him unable to perform his employment and he was temporarily totally disabled for a period of time," the suit states.

Because of his injury, Burgard filed for workers' compensation.

However, after his application, Wal-Mart fired him, causing him to lose income and benefits, suffer mental and physical anguish and pain, the complaint says.

In the two-count suit, Burgard is seeking a judgment in excess of $50,000 and punitive damages of more than $50,000, plus costs.

Jon E. Rosenstengel of the Law Offices of Bonifield and Rosenstengel in Belleville will be representing him.

St. Clair County Circuit Court case number: 09-L-242.
