Trial's opening arguments Tuesday in case against Rosewood Care Center

Potential jurors packed the third floor of the Madison County courthouse Monday before 12 were selected to hear opening arguments in a case involving an Edwardsville nursing home.

The trial resumes at 9 a.m. Tuesday. Madison County Circuit Judge David Hylla is presiding.

Plaintiff Paul Graves is suing Rosewood Care Centers of Edwardsville for negligence on behalf of his father, Alfred Graves. Paul Graves contends that his father fell while in the care of the nursing home in January 2003.

According to the plaintiff, the nursing home violated policies and procedures established by the state Nursing Home Care Act.

The case originally went to trial in 2007, ending in a mistrial after the jury failed to reach a verdict.

Graves was represented in the original case by Robert Gregory while Rosewood was represented by Kevin Hoerner.

The case is Madison County case number 03-L-834.
