Woman exiting Just One More Time restroom claims injuries

A woman is suing a St. Clair County business over injuries she says she sustained while attempting to exit a restroom.

On April 16, Vickie Ann Rosier filed a complaint in St. Clair County Circuit Court against Just One More Time, saying she fell while exiting the elevated restroom on April 6, 2008.

Because of her fall, Rosier says she suffered permanent injuries to her lower extremities, incurred medical expenses and suffered pain and disability. She also suffered a diminished earning capacity and loss of enjoyment of life, according to the complaint.

According to court records, Just One More Time was guilty of negligence by improperly operating the premises, by allowing the change in elevation of the doorway to a restroom to exist and by failing to properly place markings at the door to warn Rosier of the change in elevation.

Rosier also says Just One More Time failed to make a reasonable inspection of the restroom doorway, failed to properly post a sign inside the restroom warning of the change in elevation and failed to properly warn of the dangerous condition.

Rosier is seeking a judgment in excess of $50,000, plus costs.
