Route 161 collision is subject of suit

A St. Clair County woman has filed suit against another St. Clair County woman, alleging she was injured after a collision.

Cherri Eiland was driving east on Highway 161 in St. Clair County on March 14, 2007, when Dorothy Helfrich, who was driving west on the same road, "violently struck" Eiland's vehicle, according to the complaint filed March 13 in St. Clair County Circuit Court.

Because of the collision, Eiland sustained injuries to her chest, left side, back and left knee. She was also hindered and prevented from attending to her usual duties and affairs and lost large sums of money, the suit states.

Eiland claims she experienced great physical and mental pain, suffering and anguish and incurred substantial medical costs.

Helfrich was negligent by failing to keep a proper lookout, by failing to observe Eiland, by failing to keep her vehicle under control, by failing to apply her brakes when danger was imminent, by failing to decrease her speed to avoid striking Helfrich, by failing to turn her vehicle to avoid a collision and by failing to give proper warning of her approach, according to the complaint.

Helfrich also negligently drove too closely to Eiland, the suit states.

Eiland is seeking judgment in excess of $50,000, plus costs.

She is represented by Michael P. Hickey of Brown and Brown in Fairview Heights.

St. Clair County Circuit Court case number: 09-L-0134.
