A man has filed suit against his former attorney, alleging he is not entitled to a share of his business after a judge allegedly inaccurately recorded his divorce.
Ralph R. Shaw claims he hired Margaret J. Walsh to represent him in a Monroe County Circuit Court dissolution proceeding on Dec. 23, 1993.
In the proceeding, Ralph R. Shaw's former wife, Mary Shaw, agreed to convey ownership of certain corporate shares in his business to him, according to the complaint filed March 6 in St. Clair County Circuit Court.
However, the agreement was not accurately recorded in the judgment of dissolution, the suit states.
"Defendant knew or should have known that the Judgment of Dissolution, as was signed by the judge and filed of record in the dissolution proceedings, did not reflect the agreement of the parties to convey ownership of certain corporate shares in plaintiff's business to plaintiff," the suit states.
Ralph R. Shaw did not discover the mistake until June 8, 2007, he claims.
He is seeking a judgment in excess of $50,000, plus costs and other relief the court deems just.
Ralph R. Shaw will be representing himself.
