A Madison County woman who gave birth to twins after undergoing in vitro fertilization claims her insurance company wrongfully refused to pay for the treatment.

Melinda K. Dennis claims she requested United Healthcare Insurance Company to pay for in vitro fertilization and related treatment, but was denied coverage, even though a statute required the company to make such payments.

Thomas G. Maag of Wendler Law in Edwardsville is representing her.

"Despite Defendant's refusal to pay for said treatment, Plaintiff Dennis underwent in vitro fertilization, and related treatment, and successfully conceived and bore twins," the suit filed March 4 in Madison County Circuit Court states.

Since the insurance company refused to pay for the in vitro fertilization, Dennis was required to pay for the procedure out of her pocket.

She is seeking a judgment in excess of $50,000, compensatory damages of less than $50,000, a civil penalty of $25,000, plus costs and other relief the court deems appropriate.

She is also asking the court to reform the insurance contract.

Madison County Circuit Court case number: 09-L-0211.
