Fatal injuries in car accident leads to suit

A St. Clair County woman has filed suit against a Troy man, alleging her daughter was killed after the man collided with her.

Tammie A. Heet claims her daughter, Erika St. Arbor, was driving a 2003 Chevrolet Cavalier west on St. Charles Road near its intersection with the 2300 block of Illinois Route 159 on April 26 when David Giger, who was driving a 2001 Ford F-150 north on Illinois Route 159 near the same intersection, ran a red light and collided with her.

As a result of the accident, St. Arbor died on April 26, according to the complaint filed Jan. 23 in Madison County Circuit Court.

Heet incurred medical bills and funeral expenses and St. Arbor's family suffered the loss of her society, companionship, love, affection, guidance, support and comfort, the suit states.

Giger was negligent by failing to keep a careful forward lookout, by driving too fast, by failing to yield the right-of-way, by failing to avoid a collision, by failing to stop to avoid a collision and by driving through a red traffic signal, Heet claims.

Heet is seeking a judgment in excess of $50,000, plus costs.

She is represented by Thomas K. Neill and Morry S. Cole of Gray, Ritter and Graham in St. Louis.
