Remington Place has filed suit against John Honchak Sr. and Phyllis Chartrand, alleging Honchak did not convey the full amount of land described in a warranty deed.

Honchak executed a warranty deed on July 7, 2005, but breached his warranty of title by failing to convey all the property, the suit filed Jan. 28 in Madison County Circuit Court states.

"The fair market value of the property conveyed to the Plaintiff is worth $90,000 less than the fair market value of the property described in Exhibit A at the time of the execution of Exhibit A," the suit states.

Hochak is disabled and Chartrand was appointed as guardian of his estate, according to the complaint.

Although Remington Place has demanded Chartrand pay the $90,000, she has refused to do so, it alleges.

In addition to the money due, Remington Place is seeking other relief the court deems just.
