Bellevillle woman seeks $50k over car accident

A Belleville woman has filed suit against a Caseyville woman, alleging she was injured after the Caseyville woman struck the vehicle in which she was riding.

Moneesha Henley claims she was riding in a 1993 Toyota Camry that was heading east on Highway 15 at its intersection with South 11th Street in Belleville on Jan. 17, 2007, at about 11 p.m. when the incident occurred.

At the same time, Joyce Dave was driving west and approaching the same intersection when she lost control of her vehicle and hit the vehicle in which Henley was driving, according to the complaint filed Jan. 14 in St. Clair County Circuit Court.

Because of the accident, Henley claims numerous parts of her body and nervous system were injured and that she incurred substantial medical expenses.

She also lost substantial wages, her earning capacity has been damaged and she experienced limitations that directly impact her ability to enjoy life, according to the complaint.

Dave was negligent by failing to reduce her speed, by failing to keep a proper lookout, by failing to keep her vehicle under proper control, by driving too fast, by driving across the center of the roadway and by failing to keep her vehicle on her right-hand portion of the road, the suit states.

Henley is seeking a judgment in excess of $50,000, plus costs.

She is represented by Robert C. Nelson of Nelson and Nelson in Belleville.

St. Clair County Circuit Court case number: 09-L-0015.
