A woman who fell while walking to the bathroom has filed suit against the long-term care facility where she was living at the time of the fall.

Gertrude Baker was admitted to Beverly Enterprises after she fell at her home and sustained a hip fracture, according to the complaint filed Jan. 9 in Madison County Circuit Court.

While at Beverly Enterprises, Baker tried to find help to walk her to the bathroom, the suit states.

But upon receiving none, she attempted to walk to the bathroom by herself when she fell again on Jan. 29, 2007, she alleges.

Because of her fall, Baker received a severe and permanent personal injury that has confined her to a long-term care facility, according to the complaint.

Beverly Enterprises was negligent by having insufficient staff to provide care to Baker, by failing to monitor Baker's location, by failing to respond to her requests for assistance and by removing a pressure alarm from her bed that would have notified staff she was moving, the suit states.

In the three-count suit, Baker is seeking a judgment in excess of $150,000, plus costs and attorney's fees.
