Glen Carbon Hardee's blamed for woman's icy slip

Viola Schubert has filed suit against Hardee's Restaurant, alleging she was injured after she slipped and fell on ice outside the restaurant's exit.

Schubert was leaving the north door of the Hardee's located on 4207 S. State Route 159 in Glen Carbon on Dec. 2, 2006, when she fell on ice, according to the complaint filed Nov. 25 in Madison County Circuit Court.

Hardee's was negligent because it failed to provide a safe entrance and exit, failed to provide any handrails at the entrance and exit and allowed the entrance and exit ramp to become slippery from ice that had formed unnaturally, the suit states.

The company also negligently failed to inspect the premises to ascertain the presence of the foreign substance on the ramp, failed to timely and properly maintain and repair the located ramp at the north door to provide a safe walking surface for its customers and failed to provide any type of warning for its customers concerning the unsafe condition of the north door entrance and exit, Schubert claims.

Schubert is seeking a judgment in excess of the jurisdiction limits.

She is represented by Billie L. Johnson of Johnson and Anderson in Edwardsville.
