Marcus Burns has filed suit against the owners of the apartment where he formerly lived, claiming his back was injured after he fell on a patch of ice that had not been cleared from the front of his building.
Burns was leaving the apartment complex located at 529 Charles Avenue in Wood River on Dec. 7, 2006, at about 11 a.m. when he encountered an ice patch that caused him to slip, fall and sustain injuries, according to the complaint filed Dec. 1 in Madison County Circuit Court.
Because of the fall, Burns claims he suffered pain of his body and mind, incurred medical bills and lost money.
Granite Properties and Lafayette Square Apartments were negligent because they failed to maintain the premises in a safe condition, failed to monitor the common area to prevent unnatural accumulations of ice and snow and failed to clean unnatural accumulations of ice and snow from the common area of the apartment complex, according to the complaint.
In the four-count suit, Burns is seeking a judgment in excess of $200,000, plus costs.
