Greenmount-Route 161 accident in St. Clair County court

Debra L. Atchison has filed suit against Mark M. Urban, alleging her head, neck, shoulders, back and hands were injured after Urban rear-ended her at a stoplight.

Atchison was stopped in her 1999 Ford Escort a red light at the intersection of North Greenmount Road and Highway 161 in Belleville on Jan. 24, 2007, when Urban, who was driving south on North Greenmount Road, "collided violently" with the rear of her car, according to the complaint filed Nov. 6 in St. Clair County Circuit Court.

In addition to her injuries, Atchison experienced great pain and mental anguish, incurred medical costs and lost wages due to the accident, the suit states.

She claims Urban was negligent because he violated the care of duty he owed her, drove too fast, failed to keep a proper lookout and failed to give audible warning.

Urban also negligently failed to reduce his speed to avoid a collision, failed to keep his vehicle under control, drove too fast to stop, drove without adequate brakes, failed to obey a traffic signal and failed to yield the right-of-way, according to the complaint.

Atchison is seeking a judgment in excess of $50,000, plus costs.
