Jerry L. Morgan has filed suit against the Madison County Transit District and one of its bus drivers, claiming his shoulder was injured after the bus struck a curb.
Morgan was a passenger on a Madison County Transit bus that Jimmy R. Kie was driving east on Linden and attempting to turn right onto South Buchanan in Edwardsville on May 12, according to a lawsuit filed Oct. 15 in Madison County Circuit Court.
"The MCT bus attempted to make a right turn at a high rate of acceleration and struck the street curb on the passenger side of the bus, knocking the Plaintiff out of his seat and causing him to fall to the floor and on his left shoulder," the suit states.
Morgan claims he suffered severe injury, including permanent injuries to his left shoulder and left upper extremity.
He also spent a substantial amount on medical treatment and suffered pain, disability and disfigurement, according to the complaint.
Morgan claims Kie and the Madison County Transit District were negligent because they accelerated too quickly in a turn, failed to maintain a proper lookout, failed to keep the bus within the highway and failed to avoid striking the curb.
He is seeking a judgment in excess of $50,000, plus costs.
