Lawsuit filed over synthetic turf

Soccer For Fun

Soccer For Fun in Pontoon Beach has filed a breach of contract suit against SportExe Construction, alleging the synthetic turf they installed did not perform as promised.

According to the complaint filed Aug. 25 in Madison County Circuit Court, Soccer For Fun entered into a purchase contract with SportExe to supply and install 21,850 square feet of synthetic turf on Sept. 27, 2004.

"The Plaintiff paid the entire contract price of $64,999.00 upon the completion of the job by Defendant," the complaint states.

Soccer For Fun alleges the turf did not perform as indicated by SportExe because it was not properly installed because they used an excessive amount of filler in the product along with other installation problems.

In addition, Soccer For Fun alleges the installation and product supplied by SportExe was not in conformity with what was represented to have been installed properly which causes their employees to have to do a spraying of the area daily and repainting of the lines on the product on an on-going basis.

Soccer For Fun further alleges that the premises cannot be kept clean because seams continue to come apart, rubber splatters when a soccer ball hits the floor and the material tufts.

They claims the breach of contract has caused them to incur a substantial amount of maintenance related costs and has caused them to lose business because of the condition of the flooring and resulting unsightliness of it.

Soccer For Fun is seeking a judgment in excess of $15,000.

They are represented by M. Joseph Hill of Edwardsville.

The case is awaiting mandatory arbitration.
