Sisters sue brother over inheritance

Diane Jungk and Kathleen Heggie are suing Steven Jungk, claiming he failed to pay them inheritance money left in their parents' will.

According to the complaint filed Aug. 20 in Jersey County Circuit Court, Joann Jungk passed away Dec. 26, 2005, and Adolph Jungk died on Feb. 19, 1989. They were both the parents of Diane Jungk, Kathleen Heggie and Steven Jungk.

Steven Jungk, who is in charge of managing his parents' estate, was supposed to pay Diane Jungk and Heggie a certain amount of money within a specified period of time after their parents' deaths, but has yet to do so, the sisters claim.

There are express conditional gifts relating to the Adolph Jungk Farm included in Adolph's Last Will and Testament dated July 30, 1976, and to the Joann Jungk Farm included in Joann's Last Will and Testament dated April 1, 1998, according to the complaint.

But Steven Jungk, who was the dominant party in the relationship with Joann Jungk, interfered with Diane Jungk's and Heggie's inheritance expectancy by keeping secret a purported Quit Claim Deed, which was signed Sept. 1, 2004, the lawsuit states.

The sisters did not learn of the Quit Claim Deed until after their mother died, they claim.

"Steven Jungk is personally benefiting from tenant farming operations he is engaged in, in regard to both the Adolph Jungk Farm and the Joann Jungk Farm," the lawsuit states.

Diane Jungk and Kathleen Heggie seek sums in excess of $50,000 and for such other and further relief as may be just and proper under the circumstances, according to the complaint.

They are represented by Edward Blake of Blake and Allen in Belleville.
