Man claims taxi cab driver shot him

Michael Clark filed suit against Riverbend Taxi alleging one of their drivers opened fire and shot him in the hand and wrist.

Represented by Stephen McGlynn of Belleville, Clark claims co-defendant Harvey Benford had an ownership interest in Riverbend at the time of the shooting on Aug. 21, 2007.

Clark claims Benford intended to inflict severe emotional harm upon him and did so by shooting at him multiple times.

He claims his wounds required surgery and caused pain and suffering, medical expenses and lost wages.

Clark also claims Riverbend knew Benford was carrying a gun at the time he was shot in the Casino Queen parking lot.

He claims they were negligent because they allowed Benford to carry a firearm when they knew he was likely to use it for purposes other than self-defense and that he had violent tendencies and was unfit to carry a firearm.

In addition, Clark claims Riverbend allowed Benford to carry a firearm without performing a background check to determine his fitness to carry a deadly weapon.

Clark is seeking a judgment in excess of $30,000, plus costs.
