A man who tripped and fell on a piece of plywood at the Alton Lowe's Home Center has filed a personal injury suit in Madison County Circuit Court, alleging the store failed to keep their store reasonably safe.
In a lawsuit filed Aug. 12, Thomas Allred claims he was shopping for plumbing supplies Sept. 14, 2007, when walking near the lumber area he tripped and fell on a piece of plywood that was lying on the floor.
The complaint says he fell face-first.
Allred alleges Lowe's was negligent by failing to have routine and proper inspections, allowing the plywood to remain on the floor in an area customers were directed to walk, failing to restock the plywood and failing to warn that the plywood was on the floor.
Allred claims the fall caused injuries to his neck, low back and other areas of his body. He is represented by Michael Glisson of Alton.
He also claims his various injuries caused and continues to cause pain and suffering, medical expenses and lost wages.
Allred is seeking a judgment in excess of $50,000, plus costs of the suit.
The case has been assigned to Circuit Court Judge David Hylla.
