A woman who tripped and fell in a large hole at the Veteran's Parkway Park has filed a personal injury suit against Granite City Park District, alleging the part district failed to fill the hole.

In court papers filed July 18 in Madison County Circuit Court, Rosalie Wells claims she was at the park on Dec. 5, 2007, and fell in a hole that was left after a tree was removed last year.

"There was no sign or other warning showing that the hole was present," the complaint states.

Wells claims the part district breached their duty by willfully and wantonly:

  • failing to maintain their property;

  • failing to warn her and others of the hole;

  • failing to inspect the park and discover the hole;

  • creating a large hole on its property; and

  • failing to fill in and cover the large hole.

    Wells claims she suffered physical injuries to her whole body, including her right ankle, right knee, right elbow, right hand, neck, back and head, all of which caused and continues to cause pain, medical expenses and lost wages.

    Wells is represented by Michael Brunton of Collinsville. She is seeking damages in excess of $15,000 but less than $50,000, plus costs.

    The case is awaiting mandatory arbitration.
