Sandberg, Phoenix & von Gontard, P.C. announced a successful verdict in a wrongful death case tried in the City of St. Louis in April, Maday v. Scenic View.
Stephen M. Strum of the firm's St. Louis office and Veronica L. Armouti from the Edwardsville office defended Scenic View nursing home.
Plaintiff had alleged the wrongful death of an 80-year-old resident on a ventilator who was being weaned from her ventilator by an unlicensed respiratory therapist and died four days later.
The plaintiff alleged that no physician had ordered her removal from the ventilator. The respiratory therapist was charged with involuntary manslaughter and entered an Alford plea as a result of the incident. He was sentenced to four years in prison, served 120 days and was released.
Plaintiff's counsel sought $4 million. The jury rendered a verdict against the nursing home for $26,000, the amount of the medical specials.
