Bubby & Sissy's bar sued by patron who slips on uneven surface

Bubby & Sissy's

A woman who tripped at Bubby & Sissy's bar filed suit against the Alton tavern in Madison County Circuit Court April 16, alleging negligence due to an uneven surface.

Joyce Kyle claims that as she entered the tavern on Oct. 24, 2007, she tripped and fell on an uneven ledge located in the bar area of the establishment.

Kyle claims that Bubby & Sissy's was negligent by failing to warn visitors of the uneven surface and by failing to paint the unmarked ledge.

According to Kyle, the fall caused injuries to her arms, face and right knee that have caused and will continue to cause her to suffer pain of body and mind, incur medical expenses and lose sums of money she otherwise would have earned.

Represented by Samuel Mormino, Jr., of Alton, Kyle is seeking damages in excess of $100,000 plus costs of the suit.

The case has been assigned to Circuit Judge Nicholas Byron.
