A former employee of Advance Auto Parts filed a discrimination suit in U.S. District Court Feb. 26, alleging she was fired from her job because she is a woman.
Donita Baldwin claims she was employed at the Advance Auto Parts store at 1604 Camp Jackson Road in Cahokia for three years before she was fired Nov. 17.
"When the Defendant fired the Plaintiff it acted willfully, wantonly, and/or maliciously by discriminating against the Plaintiff because of her sex," the complaint states.
Baldwin claims her termination was in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. §2000(e).
She claims she filed a charge with the Equal Employment Opportunity Commission and was issued a right to sue letter.
"As a direct and proximate result of the Defendant's discrimination against the Plaintiff on account of her sex, the Plaintiff has sustained damages, including, but not limited to, past, present and future wages and other benefits," the complaint states.
Represented by Christopher Cueto and Lloyd M. Cueto of Belleville, Baldwin is seeking damages in excess of $75,000 plus costs.
The case has been assigned to District Judge David Herndon.
